Commercial and contractual management

Effective commercial and contractual management is critical to the success of any development.  By applying our knowledge and expertise, you gain project assurance and peace of mind regarding the robustness of the project budget from the initial idea stage through to fruition.

We provide end-to-end support to ensure that there is integrity in the estimation, budgeting, tendering, contract drafting and negotiation, commercial management and contract administration in the delivery phase.

At the point when the scheme is in a position to evaluate contractors or designers, we will lead the development of remits, proposals and contracts to form the binding agreements with the contractors to deliver the scheme.  Working with your contracts team, we will identify the most suitable contract for the type of work you require.  SLC Rail has experience in developing all the key contract types including: NEC 2 and 3, IChemE, JCT and ICE.

A well-tested commercial and legal risk-based approach will be used to develop a procurement strategy that challenges the market to ultimately provide the most appropriate risk allocation and acceptance, through the chosen form of contract.

Support throughout the process

Pre-contract stage

  • Shaping your ideas. We work with you to ensure estimates and the scope are accurate, shaping your ideas into a feasible development.
  • Budgeting. We undertake feasibility calculations, to ensure that the investment in the project is reasonable and will produce an ROI for all concerned. A tight estimate is used to inform the decision at tendering stage, whether the project is subject to OJEU or not.

Contract stage

  • Understanding where the market is on price and risk acceptance. Our experts will assess the levels and build contracts and negotiations around the current market appetite and push boundaries where possible to maximise risk transfer.
  • Our team will lead the analysis of the expressions of interest and final tenders submitted by the potential contractors.
  • We will lead the drafting of contracts and negotiations on your behalf.
  • We ensure that you control and retain the right level of risk and that contractors are managed effectively throughout the project as set out in the contracts.

Post-award stage

  • Monitoring and managing early warnings and variations. We identify variations at an early stage and understand why and how they occur.  This ensures that we can ascertain if they are reasonable and that we, as a project team manage them through effectively. 
  • We will also work with your finance team post-contract to monitor and control applications for payment, invoices submitted and manage change control if required. This fits with the wider team’s efforts in ensuring that the project is delivered to design, on time and on budget.

Blending our expertise of contractual matters with our commercial acumen ensures that the project will be awarded to contractors with a full understanding of the goals and parameters. This provides you with peace of mind and contractual security for delivery.
